Stephen Breyer was raised in a middle-class Reform Jewish family in San Francisco. Before the bench he wrote the airline deregulation that reshaped American aviation as counsel to the Senate Judiciary Committee, then taught administrative law at Harvard. Appointed to the Supreme Court in 1994, he served twenty-eight years and set out in Active Liberty and later books a pragmatic reading of the Constitution — judges should ask what a rule will do, not only what its words meant in 1789. He retired in 2022.
