Abe Fortas was the youngest of five children of Woolfe and Rachel Fortas, Orthodox Jewish immigrants in Memphis. Before joining the Court he argued Gideon v. Wainwright and won the ruling that a state must provide a lawyer to any defendant who cannot afford one. On the bench from 1965 he wrote Tinker v. Des Moines, holding that students do not shed their constitutional rights at the schoolhouse gate. His nomination as Chief Justice in 1968 was blocked by a filibuster in which antisemitic attacks were open, and he resigned the following year over a financial arrangement.
